TERMS OF SALE
Effective date: July 15, 2026
These terms govern qualifying purchases made directly through neckog.com on or after the effective date above, operated by Neckog Industries LLC ("Neckog"), 8222 North Lamar Suite F55, Austin, TX 78753, United States. They are prospective and do not retroactively alter any written agreement or resolution previously entered into by Neckog.
1. Scope and Channels
These terms apply to direct neckog.com purchases. Purchases made through a third-party platform, crowdfunding campaign (including Kickstarter), distributor, reseller, or quotation may instead be governed by the applicable campaign representations, platform terms, quotation, invoice, purchase agreement, or separately agreed written terms for that transaction.
2. Orders
An order is accepted when payment is confirmed and you receive an order confirmation email. We may cancel and refund orders affected by obvious pricing or stock errors. At checkout you are asked to affirmatively accept these Terms of Sale and the Returns & Refunds Policy; that acceptance is recorded with your order.
Customer-requested cancellations: once payment has been successfully processed, a cancellation or refund requested by the customer is subject to a nonrefundable payment-processing fee equal to the actual third-party processing cost incurred on the original transaction; the remaining balance is refunded to the original payment method. This fee does not apply when Neckog cancels the order, cannot fulfill it, when the product is defective or materially not as described, or when a full refund is required by law. 3. Prices, Tax & Payment
Prices are in US dollars, exclusive of tax. Sales tax is added at checkout for deliveries within Texas, and to in-store pickup orders (possession is taken in Texas). Payments are processed by Stripe.
4. Shipping & Delivery
Orders ship from Austin, TX. Shipping cost and carrier options are shown at checkout. Free in-store pickup may be offered. International orders may be subject to import duties and taxes payable by the recipient. Pre-order items ship on the schedule announced by email.
5. Product Categories & Returns
Different products carry different return treatment, described in full in the Returns & Refunds policy:
- Industrial equipment (Flovv, Flovv-e, and other industrial or chemical-processing equipment) is final sale and not eligible for ordinary buyer's-remorse returns, particularly once installed, powered, filled with or exposed to chemicals, modified, or damaged after delivery.
- Chemicals and consumables (resins, polyols, isocyanates, silicones, foams, pigments, cleaning fluids, mold releases) are final sale and nonreturnable after shipment except where Neckog authorizes a return in writing or applicable law requires otherwise.
- Pre-order and custom products are built or configured to order and are not eligible for ordinary returns once production begins.
- Shipping-damage and defect claims follow the notice, evidence, RMA, inspection, and remedy process in the Returns policy; legally non-waivable remedies are preserved.
- Kickstarter pledges and rewards are governed by the applicable campaign representations, Kickstarter's terms, and any later written agreement between Neckog and the backer — not automatically by this retail policy.
6. Warranty & Support
Devices are covered against genuine manufacturing defects; chemicals must be used per the supplied TDS/SDS. Products are intended for commercial, industrial, and professional use; business purchasers are responsible for evaluating suitability, chemical compatibility, facility requirements, training, ventilation, and safety before purchase. 7. Legal Savings Clause
Nothing in these terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified. If a provision conflicts with applicable law, that provision applies only to the maximum extent legally permitted.
